Usage of Services

The use of services is entirely voluntary and is the sole and exclusive responsibility of the user, provided that the user does not violate intellectual property rights or damage the services offered to them. The application can be downloaded for free from the App Store. You can also browse the website for free without any registration. To use the services in the app, registration is required. Registration and basic features are free.

User Registration

Please provide accurate and truthful information about yourself and your vehicle. To register in the application, you must provide the following information:

The information must be accurate, up-to-date, and complete. To this end, each user guarantees the authenticity of all the data provided when creating an account. If you have any questions about how we handle personal data protection, please refer to the Privacy Policy.

Your information will be stored securely and encrypted electronically, accessible only to you via your email and a verification code. Access to your account information always requires your email and the verification code. If you provide us with any information that is inaccurate, misleading, outdated, incomplete, or if we have reason to suspect the authenticity of the data provided, we reserve the right to suspend or terminate your account and restrict your access to current or future services. OneClub reserves the right to cancel the verification code at any time if the user fails to comply with any terms of service obligations.

Data security

You are not required to provide your personal data until you decide to register with OneClub. You should read and agree to the privacy policy before providing your personal data.

Communications

User generated content

OneClub does not assume responsibility for user-generated content created by you, other users, or third parties on our platform.

You agree and acknowledge that you will not upload, distribute, transmit, or otherwise make available any content, information, or material that (a) violates or infringes any copyright, patent, trademark, trade secret, service mark, trade dress, or other intellectual property right; (b) is defamatory, obscene, indecent, abusive, offensive, pornographic, or could give rise to any civil or criminal liability under applicable law; or (c) contains any errors, viruses, worms, Trojan horses, or other harmful code or program.

We reserve the right to remove or modify any content distributed by users, or to modify its usage on The OneClub, for any reason. This includes user-generated content that we believe violates the terms of our service, privacy policy, or any other policy.

You can use the "Report" button if another user posts inappropriate or unwanted content. We will respond to your request within 24 hours by either removing the content or blocking the user who posted the objectionable material.

Intellectual Property Rights

OneClub is not responsible for user-generated content that includes, but is not limited to, photos (excluding their likeness), text or phrases without mentioning the author's attribution rights because any violation of copyright constitutes a crime. You cannot post material that is the property of a third party.

Intellectual property rights are subject to assignment or license, in whole or in part, including trademarks. Direct reproduction, distribution, modification, transmission, communication, or availability for public use, extraction, or reuse through any other means or methods is strictly prohibited. Accessing or finding information, materials, or content is allowed only if it becomes legally and purposefully available. You acknowledge that intellectual property rights are not granted personally. You also state that the title and rights remain with The OneClub's exclusive rights.

Limitation of Liability

OneClub assumes no responsibility for the content submitted by users via email or any other means, as users are solely responsible for the content of the emails they send to OneClub. OneClub is not liable for accessing or using user content or their source code words, texts, or any other material that may potentially violate intellectual property rights regulations, national or international laws, or the rights of third parties. Similarly, OneClub is not responsible for security-related issues that may arise from using outdated browser versions, operating systems, incorrect configurations, computer viruses, or other reasons not directly attributable to OneClub.

In any case, OneClub shall not be liable for any direct, indirect, incidental, or consequential damages, whether in contract, strict liability, or tort (including negligence or otherwise), arising in any way out of the use of this material or the use or inability to use any member or third party's information, products, or services, even if advised of the possibility of such damage.

User responsibility

You cannot upload content that includes advertising or commercial solicitations. You are also not allowed to send commercial messages to your companions through the site. You are solely responsible for ensuring that your actions comply with the law in your interactions with other users.

Your personal photos cannot contain illegal, defamatory, obscene, or unauthorized content. Any such material will be promptly removed by The OneClub. You are responsible for ensuring that the content of your messages complies with the site's policies.

You are fully responsible for all activities occurring on your account. You agree to promptly notify us of any unauthorized use or security breach of your account that you become aware of, which could compromise your known safety measures. As the account holder, you are vigilant in protecting and ensuring the proper intended use of the services.

Changes to the Terms of Service

OneClub reserves the right to periodically modify the current terms of service content. Accordingly, OneClub recommends that users periodically review the active terms of service. OneClub may update the website and application, change content, design, and/or configuration without prior notice. Your responsibility is to be aware of and adhere to the current version of the terms of service

Refund

The complete or partial refund of spent money within the application is not possible.

Change of ownership

In the context of changing the terms of current services, all rights of the user are preserved, including those related to agreements, purchases, corporate subsidiary relations, corporate reorganization, or sales. Any changes to terms will be effective upon notification to the user.

Division

These service terms will be enforceable under applicable law. If a competent court determines that any provision of the service terms violates the law, the provision will be changed as necessary by the court to reflect the original intent of the provision to the maximum extent permitted by law, while the remaining parts of the service terms will remain unchanged.

Governing Law

The service terms and conditions are regulated and defined in accordance with Georgian law.
