This privacy policy (“Privacy Policy”) and/or any other documents applies to persons anywhere in the world who use our “Products”. Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

  • Account means a unique account created for You to access our Service or parts of our Service.

  • Service refers to the Application.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Collection of Information

When you use our products, we may collect information about you in the following general categories :

  • Personal data includes, for example, your name, ID number, phone number, car plate number, e-mail address.
  • Device information such as operating system version, device type, and system performance data.
  • Location Information: If any individual logs fill-ups, trips etc, we may collect the precise location of your device when the app is running in the foreground or background.
  • Log Information: When you interact with the Services, we collect server logs, which may include information like device IP address, access dates and times, app features or pages viewed and app crashes.
  • If your login happens through third parties like Google or Apple Sign-in, the data collected by them may be used in accordance with their privacy policies and terms of service, and we are not responsible for any bad use of this information.
  • We may include third-party advertising, links to other sites and other third-party content that will be generated based on your behavior, and there is no sharing of your personal information on One Club.

Use of Information

We may use the information we collect about you to:

  • To provide you with the Products.
  • To answer your questions or requests for information and/or customer support.
  • Develop new features.
  • To notify you about updates or changes to Product features and content and any administrative messages.
  • To provide you with promotional communications, such as notifications/email.
  • Perform internal operations, including, for example, troubleshooting software bugs and operational problems; conducting data analysis, testing, and research; and monitoring and analysing usage and activity trends.
  • Personalize and improve the Services, including providing or recommending features and content.
  • We use technologies such as cookies, tags, and scripts to enable a service to recognize your device so you don’t have to provide the same data several times during one task, to recognize that you may have already given a username and password so you don’t need to do it for every web page requested, and to measure how people are using the Products.
  • We use mobile analytics software to allow us to better understand the functionality of our mobile software on your phone. This software may record data such as how often you engage with the Products, the events that occur within the Products, aggregated usage and performance data, and where the Applications were downloaded from. We may link the data we store within the analytics software to any personal data you submit within the mobile application.
  • We may also gather certain data and store it in log files. This data may include Internet Protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data.
  • The use of social networks from our products, as well as their privacy, will depend solely and exclusively on the configuration of privacy configured in these social networks. We encourage you to review the privacy policies and settings on the social networking sites you interact with to make sure you understand the information that may be collected, used, and shared by those sites.
  • The third-party advertisers and companies, or advertising companies can use beacons and cookies to measure the effectiveness of ads, customize or optimize advertising content, and track users who click on the links made available through the service. These third parties may use cookies and web beacons to track the actions of users online over time and on different websites or platforms to provide targeted electronic ads to an individual user.

Children’s Privacy

Our service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, Please contact us. If we become aware that we have collected personal data from anyone under the age of 13 without verification of parental consent, we take steps to remove that information from our servers.

The app is available on the App Store and Google Store;

Together Website and App include accessing, browsing, registering, support correspondence, forum, product and services information; expance tracking, reminders.

User, You
The User, registered within the Services and uses Services.

We encourage You to read these Terms of Service carefully before using the Services.

Users can access, print, download and save these Terms of Service at any time. The Terms of Service will be permanently accessible on the Website and in the App. The use of the Services by Users implies acceptance of all conditions contained in these Terms of Service. By using any of the Services You confirm that You accept these Terms of Service and that You agree to comply with them. If You do not agree, You must not use the Services.

The OneClub legally reserves the right to deny access, at any time and without prior notice, to those Users who strictly do not comply with these Terms of Service.

Use of the Services
Use of the Services is entirely voluntary and under the sole and exclusive responsibility of the User, provided the User do not violate intellectual property or damage the Services offered. The App can be downloaded for free from the App Store. You can also browse the Website for no charge and without registration. To use the Services in the App, You need to register. Registration and basic features are for free.

Users Registration
We always ask You to provide actual and true information about You and Your car.. To register in the App, You have to provide the following data:

— Your first and last name;
— Your Car Make and Model
— Your email address;
— Your Phone Number

All the information must be truthful, accurate, updated and complete. For this purpose, each User guarantees the authenticity of all data provided when You create the account. If You have any questions on how We process Your Personal Data, please see the Privacy Policy.

This information is stored and protected by email and password, and access to Your account information always requires both Your email and password. If You provide any information that is untrue, inaccurate, not current or incomplete, or We have reasonable grounds to suspect provided data as such, We have the right to suspend or terminate Your account and restrict any and all current or future use of the Services. The OneClub reserves the right to disable any password at any time, if the User has failed to comply with any of the provisions of these Terms of Service.

Data Protection
We understand that We collect personal data from Our Users, so We have made the best efforts to secure Your data and to comply with applicable laws. These are stated in Our Privacy Policy. You will not be requested to provide Your Personal Data until You decide to register with The OneClub. You must read and accept the Privacy Policy before providing Personal Data.

Please treat information like the password and login confidential and do not disclose it to any third party, as You are entirely responsible for the security and confidentiality of Your password. No assignment of passwords, even temporarily, to third parties is permitted. In the event that the User knows or suspects the loss, theft or use of his/her password by others or that anyone other than the User knows his/her password, then that the User must promptly bring this to the attention of The Oneclub at info@oneclub.app

Data Deletion

You have the right to request the deletion of your personal data. If you wish to delete your data, please fill the form of Data DeletionWe will review your request and take the necessary steps to delete your personal data, in accordance with applicable laws and our data retention policies. Please allow up to 7 business days for us to process your request.Communications

User Generated Content

The OneClub takes no responsibility and assumes no liability for any User generated content that You or any other User or third party posts or transmits using our Services.

You understand and agree that You may not upload to, distribute, or otherwise publish any content, information, or other material that (a) violates or infringes the copyrights, patents, trademarks, service mark, trade secrets, or other proprietary rights of any person; (b) is libelous, threatening, defamatory, obscene, indecent, pornographic, or could give rise to any civil or criminal liability under applicable law; or (c) includes any bugs, viruses, worms, trap doors, Trojan horses or other harmful code or properties.

We reserve the right to remove or modify User content, or change the way it’s used in The OneClub, for any reason. This includes User content that we believe violates these Terms of Service, Privacy Policy or any other policies.

You can use “Report” button if there was some abusive or unwanted content from another User. We will respond to Your request within 24 hours by removing the content or ejecting the User who provided the offending content.

Intellectual Property Rights
The OneClub is not liable for the use by the Users of information that includes, but is not limited to photographs of third parties (without their consent) in the User’s profile, for using texts/ phrases without specifying the author, as this is a violation of copyright. You may not post material belonging to a third party without permission from the copyright holder. This includes but is not limited to photographs, images and text. Should You believe that material, which belongs to a third party has been posted on the App You are requested to contact Us with full details of the alleged copyright infringement including the User name.

None of the rights or obligations conferred or assumed under these Terms of Use will be construed as an assignment or license, in whole or in part, of the intellectual property rights, trademarks over the Services. It is expressly prohibited to reproduce, distribute, modify, transfer, communicate or make available to the public, extract, reuse, resend and in any other manner use by any means the Services or any of the parts or elements thereof (including, but not limited to text, design of the App, graphics, information, data of Users, Trademark etc.).It is expressly prohibited to access or obtain the information, materials or content of the Services through means or procedures other than those which, if any, have been made available to Users or have been indicated for this purpose. You acknowledge that no title to the intellectual property in the Services is transferred to You. You further acknowledge that title and full ownership rights to the Services will remain the exclusive property of The OneClub.

Limitation of Liability
The OneClub excludes liability for the content that Users send to The OneClub via email or any other means, therefore, the Users being liable for content or contributions sent by them. No matter how You provide information about Yourself, The OneClub is not responsible for false information. Similarly, The OneClub is not liable for the use that Users make of the content of the Services or their passwords, and any other material contained on the Services that potentially constitutes a violation of any regulations, national or international, of the rights of intellectual property or other rights of third parties. Similarly, The OneClub will not be held liable for any possible security errors that may occur through the use of outdated versions of browsers or operating systems, or for any consequences that may arise from either by improper configuration, computer virus or any other cause not directly related to The OneClub.

IN NO EVENT SHALL THE OneClub SHALL BE LIABLE WHATSOEVER FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, AND/OR LOSS OF PROFIT, DIRECT OR INDIRECT DAMAGES OF ANY KIND ARISING OUT OF THE DELIVERY, PERFORMANCE, OR USE OF THE SERVICES TO THE EXTENT PERMITTED BY APPLICABLE LAW. IN ANY EVENT, THE TASTEIT’S LIABILITY FOR ANY CLAIM, WHETHER IN CONTRACT, TORT WILL NOT EXCEED THE GREATER OF U.S.$ 1.00 OR TOTAL AMOUNT PAID BY THE USER IN THE TWELVE (12) MONTHS PRECEDING THE LAST EVENT GIVING RISE TO LIABILITY.

Liability of the User
You may not publish content that contains advertising or commercial messages. You may not send messages of a commercial nature to Your companion via the site. Only You are responsible for ensuring that Your interaction with other Users is lawful.

The content of Your private photos may not contain illegal, inflammatory or grossly obscene material. It will be at The OneClub’s discretion to delete content if so deemed. You are responsible for ensuring that message content is appropriate.

You are entirely responsible for all activities that occur under Your account. You agree to immediately notify Us of any unauthorized use of Your account or any other breach of security of which You become aware. You are responsible for taking precautions and providing security measures best suited for Your situation and intended use of the Services.

Changes to these Terms of Service and Services
The OneClub reserves the right to amend the content of these Terms of Service from time to time. Consequently, The OneClub recommends that Users review the terms applicable at that time when they use the Services. The OneClub may update the Website and App, change the content, design, and/or the configuration at any time without prior notice. It is Your responsibility to be aware of and abide by the current version of the Terms of Service.

Change of Ownership
We may assign these Terms of Service in their entirety, without Your consent, to a corporate affiliate or in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of Our assets. In case of change of ownership all the obligations before the Users, including subscription terms remain actual.

Severability
These Terms of Service will be enforced to the fullest extent permitted under applicable law. If any provision of the Terms of Service are held by a court of competent jurisdiction to be contrary to law, the provision will be modified by the court and interpreted so as best to accomplish the objectives of the original provision to the fullest extent permitted by law, and the remaining provisions of the Terms of Service will be unchanged.

Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Georgia. All disputes arising out of or in connection with this Terms of Service, shall be finally settled by arbitration according to the Rules of Arbitration of the Commercial Arbitration Center of the Portuguese Chamber of Commerce and Industry (Commercial Arbitration Center), by one or more arbitrator (s) appointed in accordance with the Arbitration rules. The language of arbitration shall be English. The place of arbitration shall be Lisbon.

We care a lot about Our Users and We are constantly developing and improving the Services. The App updates automatically when We release a new version, and the updates can not be turned off. We may, at Our sole discretion, revise these Terms of Service and periodically update this document with the changes.

If We make changes that materially alter Your rights, We will provide additional notice via email or through the Services.
